The Fight Continues for FL-13's Voters: We Filed Our Appeal

When over 18,400 ballots showed no vote in the 13th District race in Florida, the Republicans were quick to ignore statistical realities and allow the intent of the voters to be cast aside.

On December 29th, Judge William Gary followed suit. Ignoring statistical evidence from the nation's preeminent expert on undervotes, he ruled that there could be no independent audit of the touchscreen machines that registered the undervotes without evidence that the machines malfunctioned--evidence that by its very nature cannot be obtained without conducting an independent audit of the machines.

Today, we filed our appeal on behalf of the voiceless voters of Sarasota County.

Dear friends,

With the holidays approaching – and so much activity going on with the election contest – I wanted to provide you with an update.

This past week, MIT Professor Charles Stewart and Rice University Professor Dan Wallach presented evidence in court about widespread machine failure that suppressed thousands of votes and changed the outcome of this race. With nearly 40 percent of Americans using touch screen voting machines, an independent examination of these machines, as we’ve requested, is the only way to end the crisis in confidence about our voting system.

As Paul Kiel over at TPMmuckraker reports:

First, a little inappropriate commentary from the officials: in today's Sarasota Herald Tribune, David Drury, who's overseeing the audit, opined on its probable outcome:

... [Drury] said he expects "nothing" to be revealed from [the audit's examination of voting machines' source code].

"They're not going to find anything. It is my belief, and I rarely like to speculate but it is based upon the parallel testing, that there will be nothing found in the source code that will explain the undervote."

Hey, it's Florida! What do you expect from the election officials down there?

A little better than what we're getting, apparently. As People for the American Way protested in a statement reacting to Drury's remarks, one doesn't want "the guy in charge of the audit announcing his predictions about the outcome before the investigation of software code even begins."

Now where have we heard premature statements from elections officials before?
